FCC Warns Non-Implementation of SC Verdicts Undermines Legal Framework
ISLAMABAD: The Federal Constitutional Court (FCC) expressed serious concerns on Friday regarding the government’s failure to implement a Supreme Court judgment related to sacked employees, stating that such disregard poses a challenge to the very framework of the legal system.
This statement was made during the hearing of contempt of court petitions against both the Punjab and federal governments for not adhering to the December 17, 2021 Supreme Court ruling. This verdict aimed to protect the fundamental right to livelihood for thousands of government employees who were dismissed under a law deemed unconstitutional.
The 2021 judgment invalidated the Sacked Employees (Reinstatement) Ordinance Act 2010 (SERA), which had facilitated the employment and promotion of nearly 17,000 individuals during the Pakistan Peoples Party (PPP) era. The FCC’s remarks underscore the critical nature of judicial compliance in maintaining the rule of law and the implications for affected employees.
Looking ahead, the FCC is expected to continue addressing the contempt petitions, with potential repercussions for government officials who fail to comply with court orders. The ongoing situation raises significant questions about the government’s commitment to uphold judicial authority and the rights of citizens.
