Federal Court Rules KP Police Admin Staff Ineligible for Risk Allowance
ISLAMABAD: The Federal Constitutional Court (FCC) has ruled that the administrative staff of the Khyber Pakhtunkhwa (KP) Police are not entitled to risk allowance, a decision that clarifies the distinction between operational and administrative roles within the police force.
The judgment, delivered on Wednesday by a two-member bench led by Justice Aamer Farooq, overturned an earlier ruling from the Peshawar High Court’s Mingora Bench, which had granted the risk allowance to the administrative staff. Justice Farooq emphasized that the allowance is reserved for uniformed police personnel engaged in active duties that involve significant risks and hazards, as outlined in the KP Police Act, 2017, and the KP Police Department Ministerial Service Rules, 1974.
This ruling has significant implications for the KP Police’s administrative staff, who had anticipated the financial benefit. The court’s decision underscores the importance of clearly defined roles within law enforcement agencies and the necessity for risk allowances to be allocated based on the nature of duties performed.
Moving forward, the KP Police Department may need to reassess its policies regarding compensation and allowances to ensure that they align with the court’s interpretation. This ruling may also prompt discussions on the broader implications of risk allowances across various government departments.
