ISLAMABAD: The Supreme Court of Pakistan emphasized the critical role of lawyers’ vigilance in safeguarding clients’ cases from dismissal during a ruling on Saturday. The court stated that an advocate’s unwavering attention is a “foundational requirement” to prevent cases from being dismissed due to non-prosecution.

Justice Muhammad Ali Mazhar, in an eight-page judgment, highlighted the global legal principle encapsulated in the maxim ‘Vigilantibus et non dormientibus jura subveniunt’, which translates to the law aiding the vigilant, not those who neglect their rights. This ruling reinstated two civil revisions that had been dismissed after the petitioner’s counsel was unable to attend court due to a Coronavirus infection.

The three-member bench, led by Justice Mazhar and including Justices Musarrat Hilali and Shahid Bilal Hassan, converted the civil petitions into appeals, overturning the Lahore High Court’s rejection of restoration applications dated February 23, 2026.

This decision underscores the judiciary’s commitment to ensuring that legal representation is diligent and proactive, which is essential for maintaining the integrity of the legal process. Legal experts suggest that this ruling may encourage lawyers to prioritize case management and client communication, particularly in challenging circumstances.
