Supreme Court Summons KP Prisons Chief Over Non-Compliance with Ruling
PESHAWAR: The Supreme Court of Pakistan has issued show cause notices to the Khyber Pakhtunkhwa inspector general of prisons and the additional chief secretary (home) for failing to comply with a court order regarding the early release of a convict. The officials are required to appear in person today to explain their actions.
A bench consisting of Justices Mohammad Hashim Khan Kakar, Salahuddin Panhwar, and Ishtiaq Ibrahim directed the officials to clarify why contempt proceedings should not be initiated against them. This directive follows an appeal filed by convict Gul Nawab, who was sentenced to life imprisonment but was released after serving just under ten years.
The court noted that the calculation of Nawab’s imprisonment period appeared to contradict the applicable statutory framework, the Prison Rules, and previous legal precedents, particularly the case of Nawaz Hussain versus State, which established that life imprisonment entails a longer duration of incarceration.
This situation raises significant concerns regarding the adherence to judicial orders and the integrity of the prison system in Khyber Pakhtunkhwa. The Supreme Court’s intervention underscores the importance of compliance with legal standards and the potential consequences for officials who fail to uphold them. The court’s upcoming session is expected to clarify the legal ramifications for the involved parties and ensure accountability.
